Responsibility starts at handover and continues until the complete Equipment is physically returned and accepted by Lakeside.
Clear rules. Fair evidence.
This Hire Agreement explains what Lakeside Handy Hire supplies, what the named hirer is responsible for, how handover and return work, and how faults, damage, cancellations, security tracking and additional charges are handled. It does not remove any statutory right that cannot legally be excluded.
The normal full hire price is shown and paid at booking. Evidence is required for any properly due additional sum.
Equipment, accessories, serials, condition score, handover and return may be recorded and compared.
Contact us before the deadline if plans change. An overdue charge does not give permission to keep the Equipment.
Definitions and who the contract is with
“Lakeside”, “we”, “us” and “our” mean Lakeside Handy Hire Ltd, company number 17362091, trading as Lakeside Handy Hire.
“Customer”, “you” and “your” mean the named person or business shown on the Booking. Where you are a consumer, mandatory consumer rights continue to apply.
“Equipment” means every hired item and every attachment, battery, charger, key, guard, hose, tool, accessory, container or component supplied with it.
“Scheduled Hire Period” means the booked period shown in the order confirmation. It starts and ends at the booked times even if you collect late, unless Lakeside agrees a different time in writing.
“Responsibility Period” starts when the Equipment is handed to or released to the named Customer and ends only when the complete Equipment has been physically returned and accepted back by Lakeside.
“Booking” means the order confirmation, Equipment, dates and times, price, handover arrangements, the five accepted pre-payment Hire Agreement statements, the separate 14-day early-start request where required, any booking-specific written terms and this Hire Agreement together.
Booking, acceptance and availability
You must provide accurate contact, identity, address, payment and booking information and tell us promptly if anything material changes.
You are responsible for checking that the selected Equipment appears suitable for the intended task, surface, environment and operator. Ask before booking when you need help choosing.
Before payment for a hire, the named Customer must complete the five mandatory Hire Agreement statements. Where the hire is due to begin within 14 days of booking, the separate 14-day early-start request must also be accepted in the same Before You Pay flow before payment can proceed.
Unless the checkout clearly says the order is only a request, the contract is formed when Lakeside issues the order confirmation following payment. Release of Equipment remains conditional on required identity, payment, safety and availability checks.
We may refuse handover or cancel where Equipment is unavailable, unsafe to supply, unsuitable for the stated use, affected by a genuine operational problem, or where required checks cannot be completed.
If Lakeside cannot provide the agreed hire and you are not responsible, we will offer the most suitable available option: a reasonable substitute where appropriate, a move to another available date at no extra cost, or a full refund for the unprovided hire. You do not have to accept a substitute or new date.
Prices, payment and additional sums
The hire charge, available delivery charge, taxes and mandatory booking costs will be shown before payment. The full normal hire price is payable when the Booking is made.
No standard security deposit or £1 card-verification hold is added to normal checkout. We will not quietly add a large temporary hold after presenting the booking price.
The payment provider handles full card details. Lakeside may retain transaction status, references, limited card information and a provider token where saved payment methods are supported.
You remain responsible for reasonable sums properly due under this Agreement, including overdue hire, significant cleaning, missing accessories, lawful recovery, repair, replacement, loss of Equipment and separately evidenced direct loss caused by your breach.
Where your checkout authorisation and the payment provider permit a later charge, Lakeside may request payment from the saved payment method for a properly evidenced amount due under this Agreement. We will provide the reason, evidence and a breakdown before or when requesting the charge, and you may raise a genuine dispute or provide relevant evidence.
Identity, verification and the named hirer
The named Customer must be at least 18 and legally able to enter this Agreement.
A full identity verification may involve photo ID, liveness, facial comparison, fraud checks and, where reasonably required, proof of address. A successful full verification will normally remain valid for up to 180 days.
Lakeside may require an earlier refreshed verification where the verified ID expires, account or identity details materially change, suspicious activity is detected, the booking is unusually high-risk or identity cannot reasonably be confirmed at handover. After the 180-day period, a fresh full verification is required before the next release of Equipment.
For a returning verified Customer, Lakeside may offer a quick live face and liveness authentication at collection instead of requiring the identity document to be scanned again. Biometric authentication is used only where the required consent and privacy conditions are met. Where biometric authentication is not used or is unavailable, Lakeside will use a reasonable non-biometric alternative such as matching physical photo ID and manual verification.
Equipment will only be released to the named and approved Customer. We may refuse handover where identity information is missing, inconsistent, expired, appears false or cannot reasonably be matched to the verified account.
Identity and biometric information is handled as explained in the Privacy Policy.
Collection, delivery and handover
Collection is the default handover method. Local delivery may be offered where shown during booking and remains subject to route, address, access, Equipment and staff availability.
The named verified Customer must attend the handover unless Lakeside has approved another arrangement in writing. Equipment will not be left unattended at a doorway, garden or other location.
Lakeside may use an electronic or self-service check-out process. Handover is complete only when the system or Lakeside records the verified Customer, the Equipment released and the handover time.
Lakeside may record the Equipment, serial number, accessories, visible condition, photographs, time, signature and a visible-condition score. A score of 100/100 means no visible wear or damage was recorded at that inspection; it is not a statement that hidden faults are impossible and does not reduce statutory rights.
You must inspect the Equipment and raise any unexpected damage, missing item or disagreement with the condition record before use. Where reasonably possible, the handover record will be corrected before acceptance.
If you collect after the booked start time, the Scheduled Hire Period does not automatically move or extend. Where Lakeside causes a material delay, we will deal with the affected hire time fairly.
Where you transport Equipment, you must use a suitable vehicle and secure it safely against movement, crushing, weather and damage.
Customer responsibilities, users, fuel and permitted use
Use the Equipment only for its intended purpose, within its rated capacity and in accordance with supplied instructions, warnings and guidance.
The named Customer may allow another competent adult to operate the Equipment where appropriate, unless the booking or Equipment guidance says it is named-hirer-only. The named Customer remains fully responsible for the Equipment and for ensuring any permitted user follows this Agreement and the safety instructions.
You must not sell, sub-hire, pledge, abandon or transfer possession of the Equipment to another person or business.
Do not remove, cover or interfere with guards, safety devices, labels, serial numbers, QR codes, security markings or tracking equipment. Do not modify, dismantle or attempt to repair the Equipment unless Lakeside expressly instructs you to do so.
Petrol Equipment will be supplied with the fuel state stated at handover and battery Equipment will be supplied charged as stated. If additional fuel, battery charging, solution or consumables are needed during the hire, you must use only the type and specification stated by Lakeside or the manufacturer.
Wrong fuel, unsuitable consumables, unauthorised chemicals or incompatible charging are treated as customer-caused misuse and any resulting reasonable repair or loss is dealt with under the damage provisions.
Keep Equipment secure, reasonably protected from weather and inaccessible to children and unauthorised people. Do not use Equipment unlawfully or while alcohol, drugs, medication, exhaustion, illness or another condition makes safe control unlikely.
Safety, instructions and protective equipment
Read the Equipment-specific quick-start and safety information before switching on or beginning work.
Wear all personal protective equipment stated for the Equipment and task. You are responsible for checking that PPE fits and is appropriate.
Inspect the work area, remove avoidable hazards and keep people, animals, vehicles and property outside the safe operating area.
Plan electricity, water, leads, hoses, ventilation, access and escape routes safely. Protect electrical Equipment from rain and unsuitable wet conditions.
Do not bypass guards, overload Equipment, use it for an unsafe or illegal purpose, or continue where you cannot maintain safe control.
Faults, unsafe behaviour and hire-time credit
Stop using the Equipment immediately if it develops a fault, becomes damaged, leaks, overheats, smells unusual, loses control or behaves unexpectedly. Isolate it safely where that can be done without creating more risk and contact Lakeside promptly.
Do not continue testing, dismantle the Equipment or attempt a repair. Provide reasonable photographs, video or other information where requested and safe to obtain.
When a suspected fault is reported and you stop using the Equipment, Lakeside will record the report time while the issue is investigated.
If the problem is confirmed as a genuine Equipment fault not caused by your misuse, negligence or breach, the unusable period will be dealt with fairly from the time of prompt report. Depending on the circumstances, we may provide guidance, repair or replace the Equipment, extend or rebook the hire, end the hire, or give an appropriate refund or price reduction for the affected unused period.
If the issue was caused by misuse, wrong fuel, neglect, unauthorised repair or another customer breach, no fault-time credit is due. Lakeside may end the hire and require the Equipment back immediately.
Damage, misuse, repairs and loss of hire
Normal wear from proper use is treated differently from damage caused by misuse, neglect, unsuitable transport, unauthorised repair, contamination or failure to follow instructions.
Report damage or an incident promptly. Lakeside may inspect the Equipment and obtain a reasonable assessment for cleaning, recovery, repair or replacement.
Where your breach caused damage, you are responsible for the reasonable actual cost of assessment, recovery and repair. If the Equipment is lost or damaged beyond economical repair, you are responsible for its reasonable replacement value, taking account of age, pre-hire condition, value, repairability, salvage and betterment where appropriate.
Where your breach also directly causes Lakeside to lose a confirmed hire or incur another reasonably foreseeable loss, Lakeside may recover that separately evidenced direct loss to the extent it has not already been covered by another charge. We will take reasonable steps to reduce avoidable loss and will not recover the same loss twice.
There is no automatic penalty uplift simply because damage occurred.
Loss, theft, GPS security and the 100-mile limit
Risk of loss or theft remains with the named Customer while the Equipment is in the Customer’s possession or control. Subject to applicable law and any insurance or waiver expressly included in the Booking, theft by a third party does not by itself remove that responsibility.
Tell Lakeside immediately when Equipment is lost, stolen or cannot be returned. Theft should be reported promptly to the police and a crime reference supplied where available. You must cooperate with reasonable recovery, insurer, police and evidence requests.
Where Equipment is not recovered during the Responsibility Period, you are responsible for its reasonable replacement value and any separately evidenced direct loss properly due under this Agreement, subject to applicable law and any insurance or waiver expressly included in the Booking. The amount will take account of age, condition, salvage, insurance payments and any later recovery, and Lakeside will not obtain double recovery.
Selected Equipment may contain one or more GPS, Bluetooth, network-based location devices or other electronic security trackers used to protect and recover Lakeside property, investigate suspected misuse, support handover or loss evidence and investigate serious non-return or tracker interference. Tracking is handled in accordance with the Privacy Policy.
You must not remove, disable, shield, block, damage, interfere with or attempt to defeat a tracker or security device.
Equipment must not be taken outside a 100-mile radius of Lakeside’s Barrow-in-Furness operating base without Lakeside’s prior written permission. Knowingly breaching the location limit or interfering with tracking is a serious breach and may result in immediate termination of the hire, a demand for return and lawful recovery action.
Returning the Equipment
Return the Equipment using the agreed method, date and time. Contact Lakeside before the return deadline where delay or access arrangements have changed.
Return every supplied attachment, battery, charger, key, guard, hose, tool, container and accessory.
The named Customer remains responsible until the return handover is completed and Lakeside has accepted the complete Equipment back.
Condition, accessories and the visible-condition score may be checked against the original handover record. Return photographs and timestamps may be recorded, and further functional testing may follow. Lakeside will raise a discovered issue promptly and with reasonable evidence.
Allow Equipment to cool, isolate power, empty or secure liquids where instructed, and make it safe for transport and handling.
Cleaning and contamination
Ordinary signs of proper use are expected. Return Equipment reasonably clean, emptied where instructed and capable of normal inspection and preparation for the next hire.
Where Equipment is returned materially dirty, contaminated, full of waste or requiring significant additional cleaning beyond ordinary preparation, Lakeside may charge the reasonable actual cost of cleaning and preparation.
Tell Lakeside about paint, plaster, cement, adhesive, oil, chemicals, bodily fluids, pests, hazardous material or unusual contamination. Do not use unsafe chemicals, dismantling or pressure-washing methods unless the supplied guidance specifically permits them.
If contamination caused by your breach directly causes a separately evidenced loss of a confirmed hire, that reasonable direct loss may also be recoverable to the extent it is not already covered by the cleaning charge.
Late returns, the 30-minute grace period and extensions
An extension is valid only after Lakeside confirms it. Ask before the original return deadline. We may refuse an extension where the Equipment is reserved, required for maintenance or operationally needed.
Lakeside allows a 30-minute grace period after the agreed return time for ordinary delays. The Equipment still remains due at the booked return time and the grace period is not an automatic extension of the Booking.
If the Equipment has not been returned and accepted within 30 minutes after the agreed return time, an additional charge equal to the Equipment’s normal one-day hire rate may become due. A further normal day rate may become due for each additional started 24-hour period that the Equipment remains outstanding.
An overdue charge does not give you permission to keep the Equipment. Lakeside may still require immediate return.
If the late return directly causes Lakeside to cancel or refund another confirmed booking or causes another separately evidenced direct loss, Lakeside may recover that reasonable loss to the extent it is not already covered by the additional hire charge. We will not recover the same loss twice.
Repeated, unexplained or serious late returns may lead to future bookings being refused.
Cancellations, online rights, late collection and no-shows
Contact Lakeside as early as possible to cancel or change a Booking. A change is complete only when Lakeside confirms it.
Our normal cancellation policy: outside any statutory right that gives you a better outcome, cancelling at least 48 hours before the Scheduled Hire Period starts qualifies for a full refund of the cancelled hire.
If you cancel less than 48 hours before the start, or simply do not collect, Lakeside may retain or recover only the reasonable direct loss caused by that cancellation or no-show, including committed work or lost hire opportunity where applicable. We will take reasonable steps to reduce avoidable loss, including making the Equipment available to another customer where practical.
If you arrive late to collect, the original Scheduled Hire Period and price still apply and there is no automatic extension simply because you chose to collect late.
Consumers booking online may have a statutory cancellation right, commonly lasting 14 days after the contract is made, subject to the type of contract, exceptions and early-performance rules. Those statutory rights take priority where they apply.
If the hire is due to begin during an applicable cancellation period, Lakeside may require your express request to begin supplying the hire during that period. If you later exercise a statutory right to cancel after supply has begun, a lawful proportion may be payable for what has actually been supplied. Where the law allows the cancellation right to end after full performance, the required express request and acknowledgement will be obtained.
Faulty, unsafe, misdescribed or legally non-conforming Equipment is handled separately from a simple change of mind and nothing here removes statutory remedies.
Refusing handover, ending a hire and non-return
Lakeside may refuse handover or terminate a hire where there is a reasonable serious identity, fraud, payment, safety, unlawful-use, misuse, tracking, location or Equipment-risk concern.
Examples include failed required verification, materially false information, an unsafe intended use, an operator who appears unable to use Equipment safely, unauthorised transfer, serious damage risk, tracker interference, knowingly taking Equipment beyond the permitted area, deliberate refusal to return, or another serious or repeated breach.
Where possible and safe, Lakeside will explain the concern and allow a reasonable opportunity to resolve it. Immediate action may be necessary to protect people, property or Equipment.
Once a hire is terminated, or when Equipment is seriously overdue, Lakeside may demand immediate return and use reasonable lawful recovery measures. You must cooperate with reasonable arrangements for the return or collection of Lakeside property and, where the Equipment is at premises under your control, provide reasonable lawful access for its recovery.
This Agreement does not authorise forced entry, trespass or unlawful seizure. Where return is refused or circumstances reasonably suggest theft, fraud or deliberate permanent deprivation, Lakeside may report the circumstances to the police and/or use lawful civil recovery procedures.
Reasonable evidenced recovery costs and direct losses caused by your breach may be recoverable. Once Lakeside reasonably treats Equipment as permanently lost and claims its reasonable replacement value, overdue day-rate charges will not continue indefinitely for the same loss.
Our responsibilities and liability
Lakeside will supply Equipment and related services in accordance with applicable law and will perform services with reasonable care and skill.
To the fullest extent permitted by law, Lakeside is not responsible for loss, damage, injury, delay or cost caused by customer misuse, negligence, incompetence, wrong fuel or consumables, unauthorised modification or repair, use contrary to instructions, use by an unsuitable person, unsafe transport or storage, unsuitable use chosen by the Customer, or continuing to use Equipment after a fault or safety warning.
For consumer Bookings, and to the fullest extent permitted by law, Lakeside is not responsible for losses that were not reasonably foreseeable when the contract was made or that result from matters for which the Customer is responsible under this Agreement. For Bookings made wholly or mainly for business purposes, Lakeside also excludes indirect or consequential loss, loss of profit, loss of business and loss of opportunity to the fullest extent permitted by law.
Nothing in this Agreement excludes or restricts liability where doing so would be unlawful, including liability for death or personal injury caused by Lakeside’s negligence, fraud or fraudulent misrepresentation, or mandatory consumer rights that cannot legally be excluded or restricted.
If Lakeside breaches the Agreement, the remedy available will depend on the legal right and circumstances and may include repair, replacement, repeat performance, a price reduction, refund or damages.
Information, photographs, tracking and privacy
Lakeside may create and retain booking, identity, payment, agreement, handover, Equipment-condition, support, fault, damage, loss, tracking and return records where necessary for the purposes explained in the Privacy Policy.
Photographs or video may record the Equipment, serial number, accessories, visible condition, damage score, handover and return. These records protect both parties and support safety, maintenance, insurance and disputes.
Identity verification may involve documents, selfies, liveness, biometric comparison and proof of address through Didit or another disclosed provider. Full verification will normally be refreshed every 180 days before further Equipment release, subject to earlier risk-based refresh where justified.
Where you choose biometric authentication for a returning-customer handover, a live facial/liveness check may be used to confirm that you are the verified Customer. A reasonable non-biometric alternative will be available where required.
Selected Equipment may transmit location or security data during a hire or recovery event. Lakeside uses this for Equipment security, theft/fraud prevention, enforcing the agreed location restriction, recovery and legal evidence—not to sell customer location data or for unrelated marketing.
Personal information is handled under the Privacy Policy. Information may be shared where reasonably necessary for payment, verification, tracking/security, delivery, hosting, fraud prevention, insurance, professional advice, legal compliance or enforcing this Agreement.
General contract terms
The Booking confirmation, Equipment information, the five accepted pre-payment Hire Agreement statements, the separate 14-day early-start request where required, this Hire Agreement and any booking-specific written terms form the contract.
The version accepted for an existing Booking continues to apply to that Booking. Lakeside may update the public Agreement for future Bookings but cannot retrospectively replace the version already accepted unless a lawful change is clearly agreed.
Electronic acceptance, timestamps, order records, condition records and other electronic evidence may be used to show what was agreed and what happened during the hire.
If one provision is found unlawful or unenforceable, the remaining provisions continue as far as the law allows. A delay in enforcing a right does not automatically waive it.
A person who is not a party to the contract does not acquire a right to enforce it solely because they are mentioned.
This Agreement is governed by the law of England and Wales, without removing any mandatory consumer right to bring proceedings in another competent court.
Contact Lakeside through the Contact page for booking questions, complaints, cancellations or formal notices. We may contact you using the details supplied with the Booking.
Ask now, not after the machine leaves.
Tell Lakeside about the task, environment, access or anything you do not understand. A clear question before payment or handover is much easier to solve than an assumption halfway through the hire.
